1. Identification of the Parties.<\/span><\/h1>\n<\/header>\n

These terms and conditions govern access to and use of the URL [www.discovergalicia.es](https:\/\/www.discovergalicia.es)<\/strong>, owned by ANG\u00c9LICA LOBELLE CARVALHO, holder of the usufruct rights to the “Discover Galicia”<\/strong> trademark, domiciled at El Cango 17, Granadilla de Abona 38600, Tenerife (Spain), holding National ID (DNI) 46906332V, Wholesale-Retail Travel Agency license No. I-AV.0004680.1, telephone numbers 645929766 and 663318305, and email address: info@<\/a>caminoguanchetravel.com<\/a>, hereinafter Discover Galicia<\/strong>, through which USERS of the site (hereinafter USER or USERS) may access various information about excursions, trips and tourism.<\/p>\n

2. Purpose of the Services Offered.<\/span><\/h3>\n

2.1. The Company.<\/span><\/h3>\n

Discover Galicia<\/strong> is a trademark of the online travel agency CAMINO GUANCHE TRAVEL<\/strong>, whose main activity consists of the intermediation and\/or organization of tourism services, for which it holds the relevant licenses granted by the Autonomous Community of the Canary Islands. Through the Portal [www.discovergalicia.es](https:\/\/www.discovergalicia.es)<\/strong>, the USER is given access to and use of the various services and content made available by the company itself and\/or by third-party providers of services and content. These general terms and conditions of use govern the general use of the portal; the actual booking of the services offered through [www.discovergalicia.es<\/strong>](https:\/\/www.discovergalicia.es<\/strong>) shall be governed by its own specific general terms and conditions in accordance with the legislation in force on the matter, and the USER will be able to view and print such terms and must expressly accept them before finalizing their booking.<\/p>\n

Bookings or purchases of products or services made by the USER shall be subject to the specific terms and conditions established for each case. The USER agrees to accept and comply with the purchase terms and conditions established by Discover Galicia<\/strong>, including, but not limited to, payment of any amounts due and compliance with any rules and restrictions regarding the availability of rates, products or services. Discover Galicia<\/strong> accepts each and every obligation or prohibition imposed at any time by the legislation in force regarding the exclusion or limitation of the professional’s liability in the performance of the intermediation contract.<\/p>\n

2.2. Characteristics of the Services.<\/span><\/h3>\n

  • Discover Galicia<\/strong> offers day trips, with daily departures from Santiago de Compostela to R\u00edas Baixas, Costa da Morte, Ribeira Sacra, Ribadeo, Vigo, etc. These routes include short walking tours through sites of historical, artistic, natural or scenic interest.<\/li>\n
  • Discover Galicia<\/strong> reserves the right to set the minimum number of participants required to carry out each excursion. This minimum may vary depending on the activity booked. If the established minimum number is not reached, Discover Galicia<\/strong> may reschedule the departure, offer an alternative activity, or issue a full refund of the amounts paid.<\/li>\n
  • Making a booking through the web platform requires prior payment by the customer as a deposit.<\/li>\n
  • The company reserves the right to cancel\/postpone an excursion in cases of force majeure, such as staff illness, adverse weather forecasts, mechanical breakdowns and other factors not directly attributable to Discover Galicia<\/strong>. Should the USER be affected by a cancellation, the COMPANY undertakes to provide an alternative as soon as possible.<\/li>\n
  • The company has its own resources and staff for these activities, without prejudice to the possibility of subcontracting both to cover peaks in demand.<\/li>\n
  • Bookings are made on a “free cancellation” basis.<\/li>\n<\/ul>\n

    3. Modifications.<\/span><\/h3>\n

    The portal reserves the right to modify, limit or cancel the terms and conditions applicable to the aforementioned website, provided that prior notice is given to the USER before any such modification, limitation or cancellation takes effect.<\/p>\n

    4. Conditions of Access to and Use of the Portal.<\/span><\/h3>\n

    4.1. Technical Access Requirements:<\/span><\/h3>\n

    To access the Portal, the USER must have Internet access, pay the corresponding access and connection fees, and have the equipment and computer systems necessary to connect to the Network, including a suitable terminal (computer, phone, etc.) and a modem or other similar access device. Proper access to and use of certain content and services on the Portal requires downloading certain computer programs or other software elements onto the USER’s equipment. Such installation shall be the USER’s responsibility, and Discover Galicia<\/strong> disclaims any liability that may arise as a result.<\/p>\n

    4.2. Obligation to Make Proper Use of the Portal, Services and Content:<\/span><\/h3>\n

    a) The USER
    \nThe USER undertakes to use the Portal, the Services, the Content and these General Terms and Conditions in accordance with the law, morality, generally accepted good practice and public order. Likewise, the USER agrees to use the Portal, the Services and the Content diligently, correctly and lawfully, and not to use them for purposes contrary to these General Terms and Conditions, harmful to the interests or rights of third parties, or in any way that could damage, disable or impair the Website or its services, or prevent other USERS from making normal use of the Website. In particular, the USER undertakes to refrain from:<\/p>\n

    1\/ Reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the Content, unless authorized by the holder of the corresponding rights or unless legally permitted;<\/p>\n

    2\/ Removing, circumventing or tampering with the “copyright” notice and other identifying data relating to the rights of the rights holders included in the Content, as well as any technical protection devices or information mechanisms that the Content may contain.<\/p>\n

    3\/ Using the resources made available by Discover Galicia<\/strong> to post messages unrelated to the subject matter at hand, in particular illegal, unlawful, defamatory content, or any other content that could harm the rights of third parties or damage computer systems. Discover Galicia<\/strong> reserves the right to remove any message it deems inappropriate.<\/p>\n

    4\/ Destroying, altering, disabling or otherwise damaging data, programs, electronic documents or other material found on the Discover Galicia<\/strong> Website.<\/p>\n

    5\/ Hindering other USERS’ access to the service by massively consuming the computer resources through which Discover Galicia<\/strong> provides the service, as well as carrying out actions that damage, interrupt or generate errors in such systems.<\/p>\n

    6\/ Introducing programs, viruses, macros, applets, ActiveX controls or any other software device or sequence of characters that cause or are likely to cause any type of alteration to the computer systems of Discover Galicia<\/strong> or third parties.<\/p>\n

    b) The PORTAL:
    \nDiscover Galicia<\/strong> does not control or guarantee the absence of viruses or other elements in the Content that could cause alterations to the computer system (software and hardware) or to the electronic documents and files stored on the USER’s computer system.<\/p>\n

    4.3 Denial and Withdrawal of Access to the Portal and\/or Services:<\/span><\/h3>\n

    Discover Galicia<\/strong> reserves the right to deny or withdraw access to the Portal and\/or the Services, at any time and without prior notice, to those USERS who fail to comply with these General Terms and Conditions.<\/p>\n

    5. Liability.<\/span><\/h3>\n

    The Travel Agency shall be liable to the consumer in accordance with the obligations corresponding to its scope of management.
    \nIn addition to the liabilities set out in clause three of these general terms and conditions of use of the portal, Discover Galicia<\/strong> shall not be held directly or subsidiarily liable for:
    \nThe quality of the service, access speed, proper functioning, or the availability or continuity of operation of the portal. Discover Galicia<\/strong> also excludes any liability that may arise from interference, omissions, interruptions, computer viruses, telephone failures or disconnections in the operation of the electronic system caused by circumstances beyond the company’s control.<\/p>\n

    Information entered by USERS, collaborators and third parties.
    \nDamage that may be caused to USERS’ equipment as a result of using the portal.<\/p>\n

    If, due to force majeure (including, but not limited to, political or economic unrest or instability affecting security), deficiencies arise in the bookings, confirmations and\/or performance of any trips or services contracted through Discover Galicia<\/strong>, owing to circumstances that could not reasonably be foreseen or resolved by the company, or if it even becomes impossible to fulfil some of the agreed services, the customer waives the right to bring any claim against Discover Galicia<\/strong> unless a lack of professional diligence on the part of Discover Galicia<\/strong> is established.<\/p>\n

    Breach of the law, generally accepted morality and good practice, or public order, as a result of the transmission, dissemination, storage, provision, receipt, retrieval of or access to the Content.<\/p>\n

    Infringement of intellectual and industrial property rights, the right to honor, personal and family privacy and the right to one’s own image (photographs), property rights or rights of any other nature belonging to a third party, as a result of the transmission, dissemination, storage, provision, receipt, retrieval of or access to the Content.<\/p>\n

    6. Discover Galicia<\/strong>‘s Service Cancellation Policy<\/h3>\n

    Discover Galicia<\/strong> may cancel the service offered to customers, agencies or other travel operators in the following cases:<\/p>\n

    • Discover Galicia<\/strong> may unilaterally cancel the excursion or tour if the minimum number of passengers required to carry it out is not met.<\/li>\n
    • Discover Galicia<\/strong> may unilaterally cancel the excursion up to 10 hours before it is due to take place. Discover Galicia<\/strong> reserves the right to unilaterally withdraw the service offered for internal reasons up to 10 hours before the said service.<\/li>\n<\/ul>\n

      7. Liability:<\/span><\/h3>\n

      7.1 Of the USER:<\/span><\/h3>\n

      The USER is solely responsible for any infringements they may incur or damages they may cause through the use of the Portal; Discover Galicia<\/strong>, its partners, collaborators, employees and representatives are exempt from any liability that may arise from the USER’s actions.<\/p>\n

      The USER is solely responsible for any claim or legal action, whether judicial or extrajudicial, brought by third parties against Discover Galicia<\/strong> based on the USER’s use of the portal. Where applicable, the USER shall bear any expenses, costs and compensation incurred by Discover Galicia<\/strong> as a result of such claims or legal actions.<\/p>\n

      7.2 Of the COMPANY:<\/span><\/h3>\n

      The COMPANY undertakes to provide the services typical of a wholesale-retail travel agency and active tourism company in accordance with the legal stipulations established by the relevant authorities for such activities, and to maintain the mandatory insurance policies and trained staff required for these activities.<\/p>\n<\/div>\n<\/div>\n
